Tertiary licence agreement

Version 1.1, last updated 28 October 2026

This is an agreement between you and Caulfield Engineering LLC, doing business as Wonderland Audio, St. Petersburg, Florida, USA (“we”, “us”), support@wonderlandaudio.com. It covers the Tertiary software, its demo, its updates and its documentation (“Tertiary”). By installing or using Tertiary you agree to it. If you don’t agree, don’t install it.

1. The demo

You may install and use the demo on as many computers as you like, for as long as you like, at no charge. The demo is the full software with the effect bypassed for 10 seconds in every minute. You may not remove or work around the bypass except by buying a licence.

2. The licence you buy

When you buy a licence and we issue a key, we give you a non-exclusive, perpetual licence, transferable once as described in section 3, to:

  • install and use Tertiary on all of the computers you own or control, in any mix of Mac and Windows, with up to five activated at a time, and
  • use it for any purpose, including paid, commercial and broadcast work.

The licence is for one person: you. If several people use Tertiary, each of them needs their own licence. You can move the licence between your computers by deactivating one and activating another.

What you make with Tertiary is yours. We claim no rights in your recordings, mixes or sounds, and you owe no royalties.

3. What you may not do

  • Sell, rent, lend or give away your licence or key, or share your key with anyone else, except for the one transfer described below.
  • Activate Tertiary on more than five computers at once, or work around the activation, the weekly check or the demo bypass.
  • Copy Tertiary except to install it as allowed here and to keep backups.
  • Reverse engineer, decompile or disassemble Tertiary, except where the law allows it regardless of this agreement.
  • Remove our name or copyright notices, or distribute Tertiary or its installers yourself.
  • Use Tertiary’s code to build a competing product.

Passing your licence on, once. If you stop using Tertiary, you may transfer your licence to one other person, one time. Email support@wonderlandaudio.com from the address you bought with, with the new owner’s name and email. We deactivate your computers and issue the licence to the new owner, who then can’t transfer it again.

4. Activation and online checks

Tertiary needs an internet connection to activate. After that it checks your key with our server about once a week and keeps working for 30 days from the last successful check without a connection. After 30 days without a check, it goes back to demo behaviour until it can connect again. The check sends your email, your key, a machine ID, your operating system and the Tertiary version, as described in our privacy policy. Tertiary also asks the server whether a newer version is out.

5. Updates

Updates are free for the life of Tertiary and are covered by this agreement, or by the version of it that comes with the update. We’re not obliged to make updates.

6. Ending the licence

Your licence lasts forever unless it ends because:

  • you’re refunded, or a payment is reversed or disputed (it can be restored if the dispute is resolved in our favour), or
  • you seriously break this agreement, for example by sharing or selling your key, and don’t stop after we’ve told you.

When the licence ends, the key is switched off and Tertiary goes back to demo behaviour.

7. Ownership

Tertiary and its copyright, design and name belong to Caulfield Engineering LLC. You get the licence described here, nothing more. Tertiary is built with the JUCE framework (version 8), used under the JUCE 8 End User Licence Agreement (https://juce.com/legal/juce-8-licence/). JUCE contains open source components under their own licences, including the Steinberg VST3 SDK, Apple’s AudioUnitSDK (Apache License 2.0), HarfBuzz (MIT), SheenBidi (Apache License 2.0), FLAC and Ogg Vorbis (BSD), the Independent JPEG Group’s library, and libpng and zlib (zlib licence). Their notices are available on request. Tertiary bundles no third-party fonts. VST is a registered trademark of Steinberg Media Technologies GmbH.

8. No warranty

Try the demo before you buy: it’s the same software. Tertiary is provided “as is”. As far as the law allows, we make no warranties, express or implied, including that it will be free of errors, work in every DAW or on every computer, or suit a particular purpose. Keep backups of your projects. If the law where you live doesn’t allow some of this, those parts don’t apply to you.

9. Limit of liability

As far as the law allows, we’re not liable for any indirect, incidental or consequential loss, including lost data, lost projects, lost profits or lost work, even if we were told it might happen. Our total liability for anything to do with Tertiary is limited to what you paid for your licence.

10. General

  • This agreement is governed by the laws of the State of Florida, USA.
  • If any part of it can’t be enforced, the rest still applies.
  • If we don’t enforce a part of it straight away, we can still enforce it later.
  • This agreement, the terms of sale and the privacy policy are the whole agreement between us about Tertiary.
  • You agree to follow US export laws when using Tertiary.
